Client Agreement

Welcome to Waves Psychological Consulting! We appreciate your interest and the opportunity to work with you.
​
This service agreement is between Waves Psychological Consulting ("service provider," "we," "our") and our consultants ("consultant," "they," "their") and the client ("client," "you," "your") and governs consulting sessions. The following information will help you understand how we collaborate, your rights as a client, as well as the nature and limitations of our services.

Please read this information carefully. You may request clarification on any part of this document that may seem unclear before acceptance.

1. Agreement
​
By registering and/or booking an appointment, you confirm that you have read, understood, and agreed to this agreement and its provisions. If you do not agree to these terms, you cannot book an appointment or register for our services.
​
You understand and accept that we may change or update these terms unilaterally from time to time. If we make material changes to the terms of the agreement, we will notify you either with an update in our website or by sending you an email. Continuing to use the services after such changes constitutes acceptance of the modified terms. It is your responsibility to stay informed about changes to the agreement terms. If you do not agree to the changes, you must stop using the services.

If you are under 18 years of age, you also confirm that you have parental consent to book an appointment and register for our services.
​
2. Psychological services
​
Waves provides psychological consulting services, currently specializing in sport psychology. These services include enhancing performance through psychological skills and providing psychological support to clients, such as managing everyday stressors, coach-athlete relationships, injuries, poor performances, and more.
​
We employ an integrative approach that combines client-centered and cognitive-behavioral approaches. This means that we aim to help individuals develop and utilize their strengths, improve effective coping strategies, and increase self-awareness.
​
Important Note: Waves does not offer mental health services or therapy, which are legally restricted to psychologists, psychotherapists, or medical doctors. These include but are not limited to diagnosing or treating mental health issues.

3. Potential benefits and risks
​
Benefits:
We aim to enhance both your performance and well-being. However, the consulting process may not always result in immediate changes in your life, as everyone experiences things differently. Our goal is for you to experience overall positive outcomes as a result of this process.
Benefits may include increased psychological skills, resilience, well-being, and/or performance. Alternatively, you may find a different perspective on issues that have been troubling you. You may also benefit from the opportunity to talk things out and process your emotions or increase your self-awareness and self-understanding. Additionally, psychological consulting can help you learn new ways to think, feel, and react to yourself and others.

Risks:
The purpose of psychological consulting is to provide a safe and supportive environment for improving performance and well-being and exploring yourself or your concerns. However, clients may experience discomfort during this process.
It is possible to experience guilt, sadness, anxiety, fear, loss, frustration, anger, or other unpleasant emotions.
You may also wish to discuss painful events. These experiences are typically normal and appropriate given the work we do. We encourage you to inform the consultant of any potential negative side effects as they arise.
Meetings may also impact relationships, work, or other areas of life. Psychological consulting may also not necessarily solve all problems and requires commitment to the process to achieve desired results.
There may be security or privacy risks in the processing of personal data, such as data breaches or misuse. The service provider is committed to following appropriate security practices and standards but cannot guarantee complete security. Read more about our Privacy Policy.

5. Appointments
​
Meetings are primarily conducted remotely via Microsoft Teams. You can choose whether to use the video or audio call feature. You only need a device with an internet connection. We will send you a link to the meeting, which you can join without registration or downloading any applications.
​
During the first meeting, we typically conduct an assessment of your situation. After this, we can together decide if the consultant is the best person to provide the services you need to achieve your goals. If you decide to start psychological consulting with us, we will schedule a 45-minute meeting at a time convenient for you. The frequency and number of meetings depend on your needs, goals, and the initial meeting. We will discuss together the best solutions.

In these meetings, we address agreed-upon topics as well as new topics that you may want to discuss. To get the most out of this consulting process, we also recommend independent work, and we may give you tasks to complete between meetings. Completing these tasks or at least attempting them is highly beneficial for the process and results.

6. Financial details
​
Prices: The prices for services are available on the website. You can also purchase services in packages, where the price may differ from individually purchased meetings. These prices are also available on the website.
​
Payment: Meetings are paid for at the time of booking. Payment is made via credit or debit card through the booking site.
​
Cancellation Policy: You can cancel your booking at least 48 hours before your meeting to receive a full refund. For cancellations made later, we will refund 50% of the fee.
​
Reschedule Policy: You can reschedule your booking at least 24 hours before your meeting. In unexpected situations, we will do our best to arrange a new time even less than 24 hours before your meeting. However, we cannot guarantee a change in less than 24 hours' notice, and we may charge a fee for this service.
​
Late Arrival: You are expected to be on time for meetings. If you are running late, please notify us. Meetings will start at the scheduled time, and if you are late, meetings will still end at the agreed-upon time.
If you are late or unable to attend the meeting for any reason, the consultant will attempt to contact you with a last-minute reminder. If they cannot reach you, they will use part of the time for reviewing work and making notes.

Refunds: We will only process a refund if you have followed the above-mentioned cancellation or rescheduling policies.
We do not offer refunds if you are dissatisfied with the services or their results. The results of the services cannot be guaranteed, and doing so would be unethical. Many factors influence the outcomes of services that are beyond our control. By using our services, you acknowledge that we are not responsible for the results, and we do not process refunds related to them.

We reserve the right to reschedule meetings if the consultant is unable to work. This may include, but is not limited to, illness, emergency, or any other unexpected reason. In these cases, we will contact you as soon as possible and offer you a new time. You also have the right to cancel the meeting and receive a refund.
​
We reserve the right to cancel your meeting if it has not been paid for and no payment arrangements have been made. If your account has not been paid for more than 30 days and no payment arrangements have been made, we have the right to use legal means to collect the payment. The service provider has the right to charge interest according to the Interest Act (633/1982) for the period after the due date. Additionally, the service provider has the right to bill the customer for any collection costs incurred.

7. Ethical and legal practice
​
Waves adheres to comprehensive ethical and legal guidance in line with the statutory responsibilities of healthcare professions in Finland, where appropriate, as the work is very similar and the rights of the client are our priority.
Waves also follows the ethical guidelines of the European Federation of Sport Psychology (FEPSAC) and is committed to ensuring the safety of its clients in accordance with national and international standards and regulations in the field.
You always have the right to receive services without any discrimination and without violating your human rights and dignity.

8. Client-consultant relationship
​
A strong working relationship is essential for successful consulting. However, it's important to note that the relationship between the consultant and the client is limited to a professional relationship only.
​
9. Confidentiality
​
Sharing information about you or our work is based on the principle that nothing will be shared without your written consent. All our communication is confidential, and confidentiality lasts a lifetime.
​
However, in the high performance context, there are many individuals (such as coaches, nutritionists, doctors, etc.) who work with you, and sometimes sharing information about you and your situation among professionals can benefit both you and the overall situation.
If the consultant believes that you would benefit from sharing some information with other professional or involving another person in the discussion about a specific issue, they will bring this up. The decision to involve other individuals is then yours to make.
Similarly, if someone close to you asks the consultants about you or your work, they will share this with you, and you then decide what, if anything, to share.

Sometimes, it may be useful for the consultant to consult with other professionals about a case. If they consult with another professional, the information would be anonymous and would only include necessary details. Likewise, these professionals would be legally obligated to keep the information confidential.
​
In some situations, the consultant is legally required to take action necessary to protect you or others from harm and may need to disclose some information about the client. These situations are unusual in our work:

If the consultant reasonably believes that there is an immediate danger to the health or safety of the client or another person, they may need to take protective measures. These measures may include contacting the police, contacting a potential victim, recommending hospitalization, or contacting family members or others who need to know about the situation (Criminal Code 39/1889, Chapter 15, Section 10).

If the consultant in their duties learns about a child whose need for care and protection, conditions endangering their development, or their behavior necessitates the possible assessment of the need for child welfare, they must immediately report this to the municipal social welfare authority (Child Welfare Act 417/2007, Chapter 5, Section 25).

If the consultant in their duties receives information that an elderly person is apparently incapable of taking care of themselves, their health, or their safety, they must immediately report this to the municipal social welfare authority (Elderly Services Act 980/2012, Chapter 5, Section 25).
If the above situations arise, the consultant will limit the disclosure to only necessary information.

10. Professional records
​
Professional standards in psychology require that the consultant keeps a professional record of the meetings. The primary purpose of these documents is to ensure the quality and effectiveness of the services. These records are kept for three years after the termination of the client relationship. We adhere to all applicable data protection laws and regulations in the processing of personal data (Data Protection Act (1050/2018); General Data Protection Regulation (GDPR) 2016/679).

The documents are kept in secure locations, electronic documents are protected with strong encryption, and backups are stored in separate locations. Physical copies (if used) are kept in a locked room in a locked cabinet. Only authorized personnel have access to these documents.
If the consultant needs to terminate the client relationship due to illness, injury, or other currently unexpected circumstances, you may request them to transfer your information to another professional who will ensure confidentiality and proper storage in the future.

Except for the unusual situation where the consultant reasonably believes that disclosure could reasonably be expected to cause significant harm or danger to your or another person's life or safety, you have the right to access copies of your documents if you request it in writing. You also have the right to request correction if you believe there is an error in the file, by requesting it in writing.
Because these are professional documents, they can be misinterpreted and/or cause negative feelings in readers. For this reason, we recommend that you review them first in the presence of the consultant or transfer them to another professional so that you can discuss the content.

If another professional or someone else needs to see your documents, the consultant will discuss this with you first. If you agree to share these documents, you must sign a release form. This form specifies exactly what information is being shared, to whom and why, and also sets time limits.

11. Minors and guardians
​
Parents and clients under the age of 18 who are not of legal age should be aware that the law may give parents the opportunity to access their child's information. Because privacy is often crucial in psychology for successful progress, we agree together with the parents and the child on what information can and cannot be disclosed, and a contract is signed by all parties involved. Other communication requires the child's permission unless the consultant believes that the child is at risk or poses a risk to someone else, in which case they will inform the parents of their concerns. Before providing information to parents, the consultant discusses the matter with the child whenever possible and does their best to address any objections they may have.

12. Privacy policy
​
Your privacy and data security are important to us. By agreeing to this contract, the client confirms that they have read, understood, and agreed to Waves Psychological Consulting's and this website's privacy policy, which is also included in this agreement. Please ensure that you review is carefully.

13. Terms of service
​
The client confirms that they have read, understood, and agreed to Waves Psychological Consulting's and its website's general terms of service, which are also included in this agreement, and whose terms may apply to the client relationship as well.
​
14. Contact and contact details
​
Communication outside of sessions is limited to matters related to the client relationship, such as scheduling appointments. Contact information is provided below. You can reach out via email, phone call, or message.
Consultants may not always be immediately available by phone. When they are unavailable, please send a brief message explaining the reason for your call and request a call-back. Consultants will attempt to return your call on the same day, except on weekends and holidays. During regular work hours, we typically respond to messages within approximately 24 hours. If you are difficult to reach, please inform the consultant of when you are available. If the matter is not urgent, you may also send an email.
We do not provide on-call duty or assistance in acute situations.

15. Termination and referral
​
This agreement becomes effective when you purchase any of our services and remains in force until terminated in accordance with the terms of this agreement.
You have the right to terminate this agreement and our service relationship at any time without specific cause. If you have an appointment scheduled, the same 48-hour advance notice applies as for cancellations. By deleting your account from our service, this agreement is terminated.

If you have numerous canceled appointments or demonstrate a lack of commitment to the collaboration that we cannot resolve, we reserve the right to terminate this agreement. We also reserve the right to unilaterally terminate this agreement without specific cause. If the agreement is terminated, you are responsible for any remaining balance on your invoices, including fees for last-minute cancellations and no-shows.

Referral:
In cases where concerns/signs arise during our collaboration that there may be more serious mental health issues in your life, the consultant is ethically obligated to raise this issue with you in conversation. After that, if they remain concerned, we would suggest a referral to an appropriate professional. You are not required to follow this recommendation, but if it is made, it is strongly recommended to adhere to it. In these cases, we could continue our collaboration, but due to legal restrictions, we can only work with non-clinical issues.
We will discuss and agree on the best way to proceed together.
